The Lawsuit alleges that Private Information stored in Nth Degree Inc.’s (“Defendant,” “Nth Degree”) computer systems was impacted by a “Data Security Incident” in December of 2024.

If you received a Postcard Notice by mail, you have been identified as a Settlement Class Member, i.e., someone who resides in the United States whose Private Information was accessed or acquired during the Data Security Incident or an individual to whom Nth Degree sent notice regarding potentially compromised Private Information in the Data Security Incident.

YOUR LEGAL RIGHTS & OPTIONS IN THIS SETTLEMENT
File a Claim by July 30, 2026
File a claim to receive Settlement Benefits. Claim Forms must be submitted online or postmarked by mail by July 30, 2026.
Take no action and remain in the Settlement. You will give up your rights to sue Defendant and be bound by the Settlement, but you will not qualify for benefits.
Request Exclusion by June 30, 2026
Request exclusion and “opt out” of the Settlement. You will retain your right to sue about the claims resolved by this Settlement, and you will not be bound by the Settlement terms, but you cannot file a claim, and you will not be eligible for benefits. Opt-Out Requests must be postmarked for mail by June 30, 2026.
File an Objection by June 30, 2026
Tell the Court why you do not think the Settlement should be approved. You must remain a Settlement Class Member and can still file a claim for benefits. Objections must be filed with the Court by June 30, 2026.
File a Notice of Appearance by June 30, 2026
If you file an objection, you may request permission to address the Court about it at the Final Approval Hearing. Your Notice of Appearance must be filed with the Court by June 30, 2026.
